BOOKING TERMS AND CONDITIONS

These Booking Terms and Conditions apply to package travel arrangements organised by Hunak Journeys OÜ, including journeys marketed under the Hunak Journeys and Hunak Experiences names.
1. Introduction and company details
These Booking Terms and Conditions govern the relationship between Hunak Journeys OÜ and any traveller who books or participates in a journey organised by Hunak Journeys OÜ.
In these Terms, “Hunak Journeys”, “Hunak”, “we”, “our” or “us” means:

Hunak Experiences is a trading name or mark used by Hunak Journeys OÜ for certain products. It is not a separate contracting entity.
In these Terms, “traveller”, “participant”, “you” or “your” means a person booking or participating in a journey organised by Hunak Journeys.
Nothing in these Terms excludes, restricts or limits any statutory right or liability that cannot lawfully be excluded, restricted or limited under applicable European Union, Estonian or consumer-protection law.
2. Definitions
For the purpose of these Terms:
Package means a combination of travel services organised and sold by Hunak Journeys as a package travel arrangement within the meaning of applicable package-travel law.
Package Travel Contract means the contract between Hunak Journeys and the traveller for the package.
Booking Documents means the information and documents provided or made available to the traveller in connection with the booking. Depending on the package, these may include the Standard Information Form for Package Travel Contracts, the Journey Information Pack, these Booking Terms and Conditions, the Key Package Travel Rights information, a personalised booking summary or quotation, and any applicable appendix or detailed programme.
Journey Information Pack means the journey-specific or departure-specific document describing the principal characteristics of the package, which may include the itinerary, dates, duration, accommodation, transport, meals, activities, price, payment schedule, group size, minimum-participant requirements, cancellation information, passport and visa information, health considerations, physical requirements, insurance requirements and included or excluded services.
Booking Acceptance means the traveller's electronic or written confirmation that they wish to book the package and accept the applicable contractual terms and booking information.
Booking Confirmation means the written confirmation issued by Hunak Journeys after the booking has been accepted and the required payment has been received. It confirms the conclusion of the Package Travel Contract and is provided on a durable medium.
Durable medium means email, PDF or another medium that allows information addressed personally to the traveller to be stored and reproduced unchanged for future reference.
Unavoidable and extraordinary circumstances means a situation beyond the control of the party invoking it, the consequences of which could not have been avoided even if all reasonable measures had been taken.
Lead Booker means a traveller who makes a booking on behalf of two or more travellers.
3. Package travel status and role of Hunak Journeys
Unless expressly stated otherwise in the applicable Booking Documents, multi-day journeys organised and sold by Hunak Journeys are package travel arrangements.
Hunak Journeys acts as the organiser of these packages and is responsible for the proper performance of the travel services included in the Package Travel Contract, regardless of whether those services are performed directly by Hunak Journeys or by local partners, guides, drivers, accommodation providers, transport providers, activity providers or other suppliers.
A package may include, depending on the specific journey:
accommodation;
local transport;
guiding or hosting;
meals;
cultural visits;
walking, hiking or other outdoor activities;
camping;
boat or ferry travel;
local logistics;
other travel services identified in the Journey Information Pack.
International flights are not included unless expressly stated in the applicable Journey Information Pack and Booking Confirmation.
4. Booking Documents and documents forming the Package Travel Contract
Before booking, Hunak Journeys will provide or make available the documents and information applicable to the traveller's package. These may include:
the Standard Information Form for Package Travel Contracts;
the Journey Information Pack;
these Booking Terms and Conditions;
the Key Package Travel Rights information;
any personalised booking summary, quotation or written offer; and
any other package-specific information required by applicable law.
The Package Travel Contract consists of:
the Booking Confirmation;
the Journey Information Pack applicable to the booking;
these Booking Terms and Conditions;
any personalised booking summary or written offer expressly accepted by the traveller;
any special requirement expressly accepted by Hunak Journeys in writing;
any appendix or programme expressly incorporated into the Booking Confirmation; and
any pre-contractual information that forms part of the Package Travel Contract by operation of applicable law.
In case of inconsistency, mandatory applicable law prevails.
Subject to mandatory law, journey-specific or booking-specific terms expressly stated in the Booking Confirmation, personalised booking summary or Journey Information Pack prevail over general provisions in these Booking Terms and Conditions to the extent of the inconsistency.
General website content, social-media content, advertising and general promotional material do not override the specific contractual documents applicable to the traveller's booking.
5. Pre-contractual information and booking process
Before the traveller enters into the Package Travel Contract or makes a binding booking acceptance, Hunak Journeys will provide the pre-contractual information required by applicable package-travel law.
For a standard group departure, the booking process will normally involve:
the traveller contacting Hunak Journeys, responding to an offer or accessing a booking form;
Hunak Journeys providing or making available the applicable Booking Documents;
the traveller reviewing the Booking Documents;
the traveller completing the Booking Acceptance or booking form;
the traveller paying the required deposit or full amount; and
Hunak Journeys issuing the Booking Confirmation on a durable medium.
For online bookings, the final booking or payment step will clearly indicate where proceeding creates an obligation to pay.
By completing the Booking Acceptance, the traveller confirms that they have been given the opportunity to review the applicable Booking Documents before becoming bound.
Hunak Journeys may decline a booking request before the Package Travel Contract is concluded where it reasonably considers that:
the package is unsuitable for the traveller;
the package is no longer available;
required booking information has not been provided;
the traveller does not satisfy an expressly stated participation requirement;
operational, legal, compliance, health or safety concerns exist; or
another legitimate reason prevents the booking from being accepted.
No Package Travel Contract is concluded until the requirements in Section 7 have been satisfied.
6. Contract language
The language of the Package Travel Contract is the language selected or accepted by the traveller during the booking process.
Where the traveller agrees to receive booking documents in English, the Standard Information Form, Journey Information Pack, Booking Terms and Conditions, Booking Acceptance, Booking Confirmationand related documents may be provided in English.
Hunak Journeys may provide customer support in other languages where available.
Unless expressly stated in the Journey Information Pack or Booking Confirmation, availability of customer support in a particular language does not mean that guides, suppliers or local services during the journey will necessarily operate in that language.
7. Booking Acceptance and contract formation
For standard group departures, the Package Travel Contract is concluded when:
Hunak Journeys has provided or made available the applicable Booking Documents;
the traveller has completed the Booking Acceptance or otherwise confirmed in writing that they wish to book;
Hunak Journeys has received the required deposit or full payment; and
Hunak Journeys has issued the Booking Confirmation.
If the traveller completes the Booking Acceptance but does not make the required payment within the stated period, the booking is not confirmed.
If payment is made without completion of a required Booking Acceptance, Hunak Journeys may require completion of the missing step before confirming the booking. If the booking cannot be completed, Hunak Journeys will return the payment received, subject only to deductions permitted by applicable law.
The Booking Confirmation will normally identify:
the traveller or travellers;
the relevant journey and departure;
the package price;
the amount paid;
any balance and payment deadline;
any agreed special requirements; and
the principal documents forming the Package Travel Contract.
Where a Lead Booker makes a booking for several travellers, the Lead Booker confirms that they are authorised to make the booking and provide necessary booking information on behalf of the other travellers.
The Lead Booker must ensure that the other travellers receive the applicable Booking Documents and relevant pre-departure information. This does not reduce any statutory rights of the individualtravellers.
8. Price, deposit and payment
The total package price, deposit, balance, payment deadlines and payment method applicable to each package will be stated in the Journey Information Pack, booking information and Booking Confirmation.
Unless different payment terms are expressly stated for a particular journey:
a deposit of €500 per traveller is required to secure the booking;
the remaining balance is due no later than 60 days before departure; and
bookings made within 60 days of departure require payment of the full package price at the time of booking.
Some journeys may operate under a different deposit amount, balance deadline or payment schedule.
Where the applicable Journey Information Pack, personalised booking information or Booking Confirmation expressly specifies different payment terms, those journey-specific terms replace the standard payment schedule above for that booking.
All other provisions of these Booking Terms and Conditions continue to apply.
All prices are stated in euros unless expressly indicated otherwise.
Hunak Journeys must receive the full amount stated in the applicable payment request or invoice. Charges imposed by the traveller's bank, card issuer, payment provider or currency-conversion provider are the traveller's responsibility.
Hunak Journeys will not impose an additional payment-method charge unless such charge is permitted by applicable law and disclosed before the traveller becomes bound.
Hunak Journeys may issue invoices, receipts, payment links, bank-transfer instructions or other appropriate accounting documents depending on the payment method used.
9. Late payment
If the traveller fails to pay an amount by the stated deadline, Hunak Journeys may send a reminder and provide a reasonable final period in which to make payment.
If the payment remains outstanding after that period, Hunak Journeys may terminate the Package Travel Contract.
Termination resulting from the traveller's failure to make a required payment is treated as a traveller-related termination rather than a cancellation by Hunak Journeys under the minimum-group or unavoidable-and-extraordinary-circumstances provisions.
Any termination fee, refund or additional amount due will be calculated under Section 11 according to the date on which the contract is terminated, subject to mandatory law.
10. Prices, promotional offers and post-contract price changes
Prices may vary before booking because of promotions, early-booking offers, last-minute offers, availability, commercial decisions or other legitimate factors.
Different travellers on the same departure may therefore have booked at different prices or under different promotional conditions.
After conclusion of the Package Travel Contract, the traveller is not entitled to a refund, credit or price adjustment solely because another traveller subsequently books the same departure at a different price.
Hunak Journeys does not reserve a general right to increase the package price after conclusion of the Package Travel Contract.
A post-contract price increase may apply only where:
the applicable Journey Information Pack or other contractual document expressly reserves such a right;
the increase results from a change permitted by applicable package-travel law, such as the cost of fuel or other energy sources, taxes or fees imposed by third parties, or relevant exchange rates;
the traveller is informed clearly on a durable medium, including the justification and calculation; and
notification is provided no later than 20 days before the start of the package.
Where a contractual right to increase the price is reserved, the traveller is also entitled to a corresponding price reduction where the relevant costs decrease.
If a lawful proposed increase exceeds 8% of the total package price, the traveller will have the rights provided by applicable package-travel law, including the right to terminate the contract without a termination fee.
11. Traveller cancellation before departure
The traveller may terminate the Package Travel Contract at any time before the start of the package.
Cancellation must be communicated in writing to:
Cancellation takes effect when Hunak Journeys receives the written cancellation notice.
Unless different cancellation conditions are expressly stated in the applicable Journey Information Pack or Booking Confirmation, the following standard termination fees apply:
60 days or more before departure: the deposit stated for the package
30–59 days before departure: 50% of the total package price
15–29 days before departure: 70% of the total package price
14 days or fewer before departure: 100% of the total package price
The amount refundable to the traveller equals the payments received by Hunak Journeys minus the applicable termination fee.
Where the applicable termination fee exceeds the amount already paid, Hunak Journeys may request payment of the outstanding difference to the extent that the amount is reasonable, justified and legally recoverable.
The standardised termination fees take account of factors including:
the timing of cancellation;
expected non-recoverable commitments to suppliers;
expected cost savings arising from cancellation; and
the expected possibility of reallocating travel services to another traveller.
At the traveller's request, Hunak Journeys will provide a justification for the applicable termination fee.
Where application of a standardised fee would exceed the amount Hunak Journeys may reasonably retain or claim under applicable law in the circumstances, the fee will be reduced accordingly.
Any refund due following termination will be made without undue delay and no later than 14 days after termination of the Package Travel Contract.
Cancellation without a termination fee
The traveller may terminate the Package Travel Contract before departure without paying a termination fee where unavoidable and extraordinary circumstances occur at the destination or in its immediate vicinity and significantly affect:
the performance of the package; or
where relevant, the carriage of passengers to the destination.
In this situation, the traveller is entitled to a full refund of payments made for the package but is not entitled to additional compensation.
Unused services and voluntary withdrawal
A traveller is not ordinarily entitled to a refund solely because they:
arrive late;
voluntarily leave the journey early;
decide not to use an included service;
decide not to participate in a walk, visit, meal, transfer or activity;
fail to satisfy passport, visa, health, insurance or entry requirements applicable to them; or
are removed from the journey because of serious misconduct or refusal to comply with reasonable safety instructions.
This does not limit any statutory right to a remedy, price reduction, refund, termination or compensation where Hunak Journeys or a supplier fails to perform the Package Travel Contract properly.
Travellers are strongly encouraged to obtain appropriate cancellation and curtailment insurance where available.
12. Transfer of booking
The traveller may transfer the Package Travel Contract to another person who satisfies all conditions applicable to the package.
The traveller must notify Hunak Journeys on a durable medium within a reasonable period before the start of the package.
Notice given at least seven days before departure will normally be considered reasonable.
The replacement traveller must satisfy all requirements applicable to the package, including where relevant:
passport and visa requirements;
health and insurance requirements;
age requirements;
physical suitability requirements; and
other participation conditions stated in the Journey Information Pack.
The original traveller and replacement traveller are jointly and severally responsible for:
any outstanding balance; and
any additional fees, charges or costs arising directly from the transfer.
Hunak Journeys will inform the original traveller of the actual costs of the transfer. Such costs will not be unreasonable and will not exceed the costs actually incurred because of the transfer.
Hunak Journeys may refuse a transfer where the proposed replacement traveller does not satisfy conditions applicable to the package or where the transfer cannot reasonably or legally be completed.
13. Group size and minimum participant requirements
Hunak Journeys specialises in small-group travel and actively works to operate every advertised departure as scheduled.
A traveller's place is secured once the required payment has been received and Hunak Journeys has issued the Booking Confirmation.
Some journeys are designed to operate with a stated minimum and maximum group size.
Where a minimum number applies, the applicable minimum and maximum group size and any journey-specific cancellation deadline will be stated in the Journey Information Pack.
If, exceptionally, the minimum number of travellers is not reached, Hunak Journeys may terminate the Package Travel Contract only by notifying the traveller within the period stated for the package and no later than the maximum period permitted by applicable law.
Unless an earlier contractual deadline is stated, notification will in any event be given no later than:
20 days before the start of a package lasting more than six days;
seven days before the start of a package lasting between two and six days; or
48 hours before the start of a package lasting less than two days.
Where Hunak Journeys terminates a package because the stated minimum number has not been reached, all payments made for the package will be refunded in full without undue delay and no later than 14 days after termination.
Hunak Journeys may instead offer voluntary alternatives, including:
transfer to another departure;
an alternative package; or
where commercially possible, operation of the journey with fewer participants under revised conditions.
The traveller is not required to accept an alternative package, travel credit, revised departure or revised price.
Any revised price or supplement applies only if expressly accepted by the traveller.
14. Cancellation or termination by Hunak Journeys before departure
Hunak Journeys may terminate the Package Travel Contract and provide a full refund without additional compensation where:
the number of travellers enrolled for the package is below the minimum number stated in the Package Travel Contract and notice is provided within the applicable contractual and statutory deadline; or
Hunak Journeys is prevented from performing the Package Travel Contract because of unavoidable and extraordinary circumstances and informs the traveller without undue delay before the start of the package.
In either case, all payments made for the package will be refunded in full without undue delay and no later than 14 days after termination.
Where Hunak Journeys cancels a package for another reason for which applicable law provides a right to compensation in addition to a refund, nothing in these Terms limits that right.
Failure by the traveller to comply with a material contractual obligation, including a requirement to:
make a required payment;
provide required information;
satisfy a mandatory insurance requirement;
satisfy an applicable passport, visa or health requirement; or
comply with an expressly stated participation requirement,
will be treated as a traveller-related breach or termination rather than a cancellation by Hunak Journeys under the first part of this section.
Where reasonably possible, Hunak Journeys will provide the traveller with an opportunity to remedy such a breach before terminating the booking.
Any refund or termination fee following a traveller-related breach will be calculated under Section 11 according to the date of termination and subject to applicable law.
Where a refund is legally due, any offer of travel credit, transfer to another departure or alternative package is voluntary. The traveller is not required to accept credit instead of a monetary refund.
15. Changes before departure
Hunak Journeys may make insignificant changes to the Package Travel Contract before departure where:
Hunak Journeys has reserved the right to do so;
the change is insignificant; and
the traveller is informed clearly and comprehensibly on a durable medium.
Insignificant changes may include reasonable adjustments to timings, meeting arrangements, the order of visits or similar operational details where these do not materially affect the nature, quality, suitability, duration or value of the package.
Substitution of accommodation or another travel service will be regarded as insignificant only where the substitute remains reasonably comparable and does not materially alter a main characteristic of the package.
If, before departure, Hunak Journeys is constrained to:
significantly alter a main characteristic of the package;
substantially change an accepted special requirement; or
propose another significant contractual change,
Hunak Journeys will inform the traveller clearly on a durable medium and provide a reasonable period in which to choose between:
accepting the proposed change;
terminating the Package Travel Contract without a termination fee; or
accepting a substitute package, where one is offered.
The notice will explain the consequences of the traveller's decision or failure to respond where required by applicable law.
Where the traveller terminates because of a significant change and does not accept a substitute package, Hunak Journeys will refund all payments made for the package without undue delay and no later than 14 days after termination.
Where a modified or substitute package is of lower quality or cost, the traveller is entitled to an appropriate price reduction.
16. Itinerary flexibility and operational changes during the journey
Hunak journeys may take place in environments where exact timings, routes and activities depend on factors including:
weather;
terrain;
sea or volcanic conditions;
safety and security;
local permissions;
transport availability;
vehicle or equipment conditions;
ferry or local transport schedules;
group pace;
environmental protection;
local access restrictions; and
other operational circumstances.
Reasonable operational flexibility is therefore part of the nature of some journeys.
Hunak Journeys, its guides, local partners and authorised representatives may make reasonable operational adjustments during the journey where necessary or appropriate for:
safety or security;
weather or terrain;
environmental protection;
cultural sensitivity;
animal welfare;
local conditions;
operational quality;
group welfare; or
compliance with local law or instructions from authorities.
Such adjustments may include:
changes to the order or timing of visits;
route adjustments;
campsite changes;
replacement of accommodation with a reasonably comparable alternative where possible;
transport timing changes;
walking-route adjustments;
substitution of guides, drivers or local staff; and
activity timing changes.
Hunak Journeys will seek to preserve the overall duration, nature, quality and principal characteristics of the package.
Where a change constitutes or creates a lack of conformity that substantially affects performance of the package, the traveller's mandatory rights under applicable package-travel law remain fully applicable.
17. Performance of the package and organiser responsibility
Hunak Journeys is responsible for the proper performance of the travel services included in the Package Travel Contract.
This responsibility applies regardless of whether the services are performed directly by Hunak Journeys or by local partners, guides, drivers, accommodation providers, transport providers, activity providersor other suppliers.
The traveller must inform Hunak Journeys, the guide or the designated contact point without undue delay of any lack of conformity or problem perceived during performance of the package.
Hunak Journeys will seek to remedy a lack of conformity unless remedy is impossible or would involve disproportionate costs, taking into account the extent of the lack of conformity and the value of the affected travel service.
18. Lack of conformity, remedies, price reduction and compensation
If a travel service is not performed or is improperly performed, the traveller should report the issue as soon as reasonably possible so that Hunak Journeys or the local team has an opportunity to address it.
Where Hunak Journeys does not remedy a lack of conformity within a reasonable period set by the traveller, the traveller may, where permitted by law, remedy the problem themselves and request reimbursement of necessary expenses.
The traveller does not need to set a period for remedy where:
Hunak Journeys refuses to remedy the problem; or
immediate remedy is required.
Where a significant proportion of the travel services cannot be provided as agreed, Hunak Journeys will offer suitable alternative arrangements at no extra cost, where possible of equivalent or higher quality.
Where the proposed alternatives are of lower quality, an appropriate price reduction will be provided.
The traveller may reject proposed alternative arrangements where they are not comparable to what was agreed in the Package Travel Contract or where the price reduction offered is inadequate.
Where the lack of conformity substantially affects performance of the package and Hunak Journeys fails to remedy it within a reasonable period, the traveller may have the right to terminate the contract without a termination fee.
The traveller may be entitled to an appropriate price reduction and/or compensation for damages where the package is not performed or is improperly performed.
Compensation for damages may not be due where Hunak Journeys proves that the lack of conformity is:
attributable to the traveller;
attributable to an unconnected third party and was unforeseeable or unavoidable; or
due to unavoidable and extraordinary circumstances.
Nothing in this section limits any mandatory right available under applicable package-travel law.
19. Assistance to travellers in difficulty
Hunak Journeys will provide appropriate assistance without undue delay if a traveller is in difficulty during the journey.
Assistance may include, where appropriate:
providing information concerning health services, local authorities or consular assistance;
helping with distance communications;
helping the traveller identify alternative travel arrangements;
contacting an emergency contact;
coordinating with local partners or suppliers.
Hunak Journeys may charge a reasonable fee for assistance where the difficulty was caused intentionally by the traveller or through the traveller's negligence, to the extent permitted by applicable law.
Any such fee will not exceed the actual costs incurred by Hunak Journeys.
20. Nature of Hunak journeys and informed participation
Hunak Journeys organises small-group and private journeys that may take place in remote, semi-remote, rural, outdoor or environmentally exposed settings.
Depending on the package, a journey may involve:
remote or isolated environments;
limited infrastructure;
walking or hiking;
uneven or unmarked terrain;
camping or sleeping outdoors;
off-road travel;
long driving periods;
boat or ferry travel;
heat, cold, wind, dust, rain or other weather exposure;
limited sanitary facilities;
limited or delayed access to medical care;
evacuation constraints;
local food and accommodation standards different from those familiar to the traveller;
cultural encounters and local-community settings;
interaction with animals or livestock; and
changes to planned arrangements resulting from local or environmental conditions.
The applicable Journey Information Pack describes the principal characteristics, travel style, physical requirements, accommodation and comfort level, activities and relevant conditions of the specific journey.
The Journey Information Pack is an important part of the traveller's assessment of whether the package is suitable for them.
By completing the Booking Acceptance, the traveller confirms that they have had the opportunity to review the itinerary, travel style, physical requirements, accommodation and comfort level, activities and relevant conditions described for the journey and to raise any material questions before booking.
Remote, outdoor and expedition-style travel may involve inherent risks that cannot be eliminated entirely even where reasonable care is exercised.
The traveller agrees to participate with the reasonable level of personal responsibility, flexibility, preparation and respect required by the nature of the journey.
Nothing in this section constitutes a waiver of the traveller's statutory rights or excludes or limits Hunak Journeys' responsibility where exclusion or limitation would be unlawful.
21. Traveller fitness, health and disclosure duties
The traveller is responsible for considering whether they are physically and medically able to participate in the package described in the Journey Information Pack.
Before departure, the traveller must inform Hunak Journeys of any health, mobility, dietary or other circumstance that is reasonably relevant to:
their safe participation;
the safety of other travellers;
arrangements Hunak Journeys or its local suppliers reasonably need to make;
accommodation, food or transport arrangements;
participation in included activities; or
emergency planning.
Relevant information may include, where genuinely necessary:
allergies;
dietary requirements;
mobility restrictions;
medication requiring specific handling or storage;
pregnancy;
a condition affecting participation in included activities; or
another circumstance reasonably relevant to safe operation of the journey.
Hunak Journeys does not require travellers to disclose unrelated medical information.
Hunak Journeys will request and process health or other sensitive information only where reasonably necessary for booking, safety, operational arrangements or legal requirements and in accordance withapplicable data-protection law.
Hunak Journeys may, where reasonable:
request additional relevant information;
request appropriate medical clearance;
discuss reasonable adaptations or limitations;
decline a booking before confirmation where the package cannot safely or reasonably accommodate the traveller;
require a traveller to refrain from a particular activity; or
remove a traveller from an activity or journey where continued participation creates a serious safety or operational risk.
Failure to disclose material information reasonably required for safe participation may result in refusal of participation or traveller-related termination, subject to these Terms and mandatory law.
22. Participation of minors
Unless otherwise stated in the Journey Information Pack, the minimum age for participation is 15 years.
A Journey Information Pack may expressly allow participation by younger travellers where Hunak Journeys considers the specific package suitable.
Travellers under the age of 18 may participate only when accompanied throughout the package by:
a parent;
a legal guardian; or
another responsible adult accepted by Hunak Journeys.
The accompanying adult remains responsible for appropriate supervision of the minor.
Hunak Journeys may require additional consent, identity or emergency-contact documentation for minors.
Hunak Journeys may decline participation by a minor where the package is not reasonably suitable considering the itinerary, physical demands, remoteness, accommodation, activities and safety requirements.
23. Passports, visas, vaccinations and entry requirements
Hunak Journeys will provide the general passport, visa and health-formality information required by applicable package-travel law before the Package Travel Contract is concluded.
The traveller remains responsible for checking and satisfying the specific requirements applicable to their:
nationality;
passport;
country of residence;
travel route;
transit arrangements;
health circumstances; and
date of travel.
The traveller is responsible for obtaining and maintaining all passports, visas, entry permits, vaccination evidence and other documents or authorisations required for travel.
Hunak Journeys may provide additional practical information concerning visas, entry procedures, health precautions or local regulations.
Such information does not replace personalised advice from an embassy, consulate, government authority, medical professional or competent travel-health body.
Hunak Journeys is not responsible for denied boarding, denied entry, delay, additional cost or loss caused by the traveller's failure to obtain or maintain documents or formalities applicable to them, except to the extent that the problem results from a failure by Hunak Journeys to fulfil a mandatory information obligation.
24. Travel insurance and health cover
Appropriate personal travel insurance or equivalent cover may be a mandatory condition of participation where this is stated in the applicable Journey Information Pack.
For journeys involving remote destinations, limited access to medical facilities, evacuation constraints or activities involving elevated travel risk, Hunak Journeys will normally require insurance that includes, as appropriate:
emergency medical treatment;
hospitalisation;
emergency medical evacuation;
rescue where relevant to the included activities; and
medical repatriation, including in the event of serious illness, injury or death.
The applicable Journey Information Pack may specify additional minimum insurance requirements appropriate to the destination or activities.
Travellers must ensure that their policy covers:
the destination;
the entire period of travel;
the relevant activities;
declared pre-existing medical conditions where required by the insurer; and
any other condition expressly identified in the Journey Information Pack.
For journeys within the European Economic Area, Switzerland or another territory where a traveller has access to reciprocal or public healthcare arrangements, Hunak Journeys may recognise evidence of such entitlement for the ordinary medical-treatment component where appropriate to the package.
Travellers should understand that the European Health Insurance Card, GHIC and comparable public-health arrangements are not substitutes for comprehensive travel insurance and do not generally provide cover for all risks, including medical repatriation, rescue, private healthcare, cancellation or baggage loss.
Unless expressly made mandatory for a particular journey, insurance covering:
cancellation;
curtailment or trip interruption;
personal accident;
personal liability; and
loss, theft or damage to personal belongings
is strongly recommended.
Where insurance is a mandatory condition of participation, the traveller must normally provide the required insurance information no later than 14 days before departure.
For a booking confirmed within 14 days of departure, the traveller must provide the information as soon as reasonably possible after booking and in all cases before participation.
Hunak Journeys may request reasonable evidence including:
insurer name;
policy number;
insurance period;
emergency-assistance telephone number; and
evidence that mandatory medical, evacuation, repatriation or activity-related requirements are covered.
The traveller should carry or have accessible the insurer's emergency-assistance information during the journey.
If adequate evidence is not provided by the required deadline, Hunak Journeys may provide the traveller with a reasonable final period in which to remedy the deficiency.
If the traveller still fails to demonstrate the required cover, Hunak Journeys may refuse participation or terminate the booking where the insurance requirement is a material condition of that package.
Any refund or termination fee following such termination will be determined under Section 11 according to the date of termination and applicable law.
There is no automatic rule that failure to provide insurance results in forfeiture of the entire package price irrespective of the timing of termination.
Hunak Journeys' statutory insolvency protection is entirely separate from personal travel insurance or healthcare cover.
25. Traveller conduct, safety instructions and guide authority
The traveller must comply with reasonable instructions issued by Hunak Journeys, guides, local partners, drivers, hosts, expedition leaders or other authorised representatives.
Instructions may concern:
safety and security;
timings;
vehicle travel;
walking routes;
camping;
health and hygiene;
environmental protection;
local law;
cultural norms;
photography;
animal welfare;
accommodation rules; and
group conduct.
During the journey, guides and local teams have operational authority to make reasonable day-to-day decisions concerning safety, timing, routes, local conduct and delivery.
A traveller must not behave in a manner that:
endangers themselves or another person;
seriously disrupts the journey;
violates applicable law;
harasses, abuses, threatens or discriminates against another person;
seriously disrespects local communities, fellow travellers or staff;
damages property, equipment, accommodation, cultural sites or the environment; or
refuses to comply with reasonable safety instructions.
Hunak Journeys may remove a traveller from an activity or journey where their conduct creates a serious safety, legal or operational risk or substantial disruption.
Where removal results from the traveller's misconduct, unlawful conduct or refusal to comply with reasonable safety instructions, the traveller is not ordinarily entitled to a refund for unused services, subject always to mandatory law.
26. Responsible travel and cultural and environmental conduct
Travellers are expected to follow responsible-travel principles during Hunak journeys.
This includes:
respecting local communities and cultural practices;
following appropriate guidance regarding dress, conduct and photography;
minimising waste where reasonably possible;
respecting wildlife and animals;
avoiding damage to natural, cultural, archaeological or religious sites;
following leave-no-trace principles where applicable; and
respecting the privacy and dignity of local people and fellow travellers.
Hunak Journeys may issue reasonable instructions designed to protect local communities, landscapes, animals, cultural heritage or the integrity of the journey.
27. Damage caused by travellers and personal liability
The traveller is responsible, to the extent permitted by applicable law, for direct and reasonable loss or cost caused by their:
negligence;
reckless or intentional conduct;
breach of local law;
serious breach of these Terms; or
failure to comply with reasonable instructions.
This may include reasonable costs arising from damage caused by the traveller to:
accommodation;
vehicles;
equipment;
property;
cultural or natural sites; or
property belonging to another traveller or third party.
Hunak Journeys may request reimbursement only for costs or liabilities that are reasonably attributable to the traveller's conduct and legally recoverable.
Where reasonably requested, Hunak Journeys will provide evidence supporting such a claim.
Travellers are strongly encouraged to hold appropriate personal-liability insurance.
Nothing in this section reduces Hunak Journeys' statutory responsibility as organiser for proper performance of the package.
28. Local partners and service providers
Hunak Journeys works with local partners, guides, drivers, hosts, accommodation providers, transport providers, activity providers and other suppliers.
Some or all travel services included in a package may therefore be delivered locally by independent suppliers.
Where Hunak Journeys is the organiser of the package, Hunak Journeys remains responsible to the traveller for proper performance of the travel services included in the Package Travel Contract, regardless of its rights against a supplier.
Local guides and partners may make reasonable operational decisions concerning:
safety;
logistics;
environmental conditions;
cultural considerations;
local permissions; and
day-to-day delivery.
29. Liability, exclusions and mandatory rights
Hunak Journeys is not liable for loss, damage or lack of conformity to the extent that Hunak Journeys proves it is attributable to:
the traveller;
a third party unconnected with the provision of the travel services where the event was unforeseeable or unavoidable; or
unavoidable and extraordinary circumstances,
to the extent provided by applicable law.
Hunak Journeys is not responsible for consequences arising solely from the traveller's:
failure to comply with reasonable safety instructions;
failure to obtain documents or visas applicable to them;
failure to satisfy a properly disclosed mandatory insurance or health requirement;
failure to disclose material information reasonably necessary for safe participation; or
unlawful, reckless or intentional conduct.
Nothing in these Terms excludes or limits liability for death or personal injury where such exclusion or limitation would be unlawful.
Nothing in these Terms excludes or limits liability for intentional conduct, negligence or another category of liability that cannot legally be excluded or limited.
Where an international convention binding on the European Union lawfully limits the extent or conditions of compensation payable by a provider performing a travel service included in the package, the corresponding limitation may apply to Hunak Journeys to the extent permitted by package-travel law.
Any other limitation applies only to the extent expressly permitted by mandatory law.
30. Unavoidable and extraordinary circumstances
Unavoidable and extraordinary circumstances may include, depending on the circumstances:
natural disasters;
war or armed conflict;
serious political instability;
civil unrest;
terrorism or significant security deterioration;
border closures;
epidemics, pandemics or serious health emergencies;
government restrictions;
major strikes;
extreme weather;
flooding;
landslides;
blocked or unsafe routes;
major transport disruption;
restrictions imposed by local authorities; or
comparable circumstances beyond the control of the party invoking them.
Hunak Journeys will make reasonable efforts to provide appropriate information, assistance and alternatives where operationally possible.
Where unavoidable and extraordinary circumstances create statutory rights to termination, refunds, assistance, alternative arrangements or accommodation, those rights remain fully applicable.
Nothing in this section removes any mandatory right of the traveller.
31. Complaints and problem reporting
If the traveller experiences a problem during the journey, they should inform the guide, local partner, Hunak Journeys representative or designated emergency contact as soon as reasonably possible.
This gives Hunak Journeys and the local team an opportunity to address the issue during the journey where feasible.
If the issue cannot be resolved during the journey, or the traveller wishes to make a formal complaint, the traveller should write to:
The complaint should, where possible, include:
the traveller's name;
booking reference;
journey and departure date;
a description of the issue;
when and to whom the issue was reported during the journey; and
relevant supporting evidence.
Hunak Journeys will provide a written response to a written consumer complaint within 15 days, or otherwise within the period required by applicable law.
Where the matter cannot reasonably be fully resolved within that period, Hunak Journeys may explain the position and any further steps required.
Where a dispute cannot be resolved directly, an eligible consumer may have access to an applicable consumer dispute-resolution body, including where relevant the Estonian Consumer Disputes Committee, the European Consumer Centre network or a competent court.
32. Photography, media and privacy during the journey
Hunak Journeys may take photographs, videos, notes or other documentary material during journeys for legitimate internal, operational or documentary purposes.
Separate consent will be requested where required before identifiable photographs, videos, testimonials or interviews of a traveller are used for advertising or promotional marketing.
Travellers who do not wish to appear in identifiable promotional material may inform Hunak Journeys before departure and should also inform the guide or host where appropriate during the journey.
Travellers must respect the privacy, dignity and cultural expectations of:
local people;
children;
fellow travellers;
guides and staff;
religious or culturally sensitive sites; and
security-sensitive locations.
Travellers should obtain appropriate permission before photographing or recording people or situations where consent is reasonably required.
33. Data protection
Hunak Journeys processes personal data in accordance with its Privacy Policy and applicable European Union and Estonian data-protection law.
Personal data may be processed for purposes including:
responding to enquiries;
managing bookings;
providing contractual and pre-contractual information;
arranging travel services;
communicating with travellers;
health, safety and emergency planning;
satisfying legal and accounting obligations;
handling incidents and complaints; and
administering payments.
Where necessary for booking, operational, safety or legal purposes, Hunak Journeys may share relevant and proportionate traveller information with:
local partners;
guides and hosts;
accommodation providers;
transport providers;
activity providers;
emergency contacts;
insurers;
payment providers;
professional advisers; or
other relevant suppliers.
Health, dietary, mobility and emergency information will be requested only where reasonably relevant and will be handled with appropriate safeguards.
The Hunak Journeys Privacy Policy provides further information concerning data processing, retention and traveller rights.
34. Website information and obvious errors
Hunak Journeys makes reasonable efforts to ensure that website content, prices, dates, descriptions and availability information are accurate.
Errors, omissions or changes may nevertheless occur.
Before conclusion of the Package Travel Contract, Hunak Journeys may:
correct obvious errors;
update information;
revise journey details; and
correct availability information.
Once the Package Travel Contract has been concluded, contractual changes will be handled in accordance with these Terms and applicable package-travel law.
Where an obvious pricing or description error is identified before Booking Confirmation, Hunak Journeys may decline the booking request and refund any payment received.
35. Private journeys and special conditions
Private journeys are designed following consultation between Hunak Journeys and the traveller or group organiser.
A private journey may constitute a package travel arrangement where it combines travel services within the meaning of applicable law.
For private journeys, the following may differ from Hunak's standard group-departure conditions:
itinerary;
price;
deposit;
balance-payment deadline;
cancellation conditions;
minimum-group requirements;
inclusions;
accommodation; and
other package-specific conditions.
Any such special conditions will be provided before the traveller is asked to make a binding booking acceptance or payment.
Changes requested by the traveller after Booking Confirmation may:
require repricing;
incur additional costs;
affect availability;
require supplier approval; or
be impossible to accommodate.
Hunak Journeys may decline a requested change where it would compromise:
safety;
operational feasibility;
contractual commitments to suppliers;
environmental responsibility;
cultural sensitivity;
animal welfare;
journey quality; or
legal compliance.
36. Statutory insolvency protection
Hunak Journeys maintains statutory insolvency protection for its package-travel activity in accordance with Estonian law.

37. Governing law, consumer rights and dispute resolution
These Terms and the Package Travel Contract are governed by Estonian law.
This choice of law does not deprive a consumer of mandatory protection available under the law that would otherwise apply to them and which cannot lawfully be excluded by agreement.
The parties will first seek to resolve disagreements through direct communication.
Where a dispute cannot be resolved directly, the traveller may have the right, depending on the circumstances and applicable jurisdiction, to refer the matter to:
an applicable consumer alternative-dispute-resolution body;
the Estonian Consumer Disputes Committee;
the European Consumer Centre network in a cross-border consumer matter; or
a competent court.
Nothing in this section restricts any mandatory jurisdictional or consumer-protection right available to the traveller.
38. Severability
If any provision of these Terms is held to be invalid, unlawful or unenforceable, the remaining provisions remain in force to the fullest extent permitted by law.
Where legally possible, an invalid or unenforceable provision will be interpreted in a manner that most closely reflects its lawful purpose.
